New Brunswick businessman Dennis Oland has been released from jail after spending the last 10 months behind bars.
Oland was convicted of second degree murder last Decemeber in the death of his father, Richard.
However, the conviction was negated yesterday by New Brunswick’s Court of Appeal because the judge did not properly instruct the jury in the original trial.

No date has been set for a new trial.
Oland will be released on strict conditions, including $50,000 bail and will need to give up his passport.
Meantime, defence lawyer Alan Gold says it’s going to be a much better Christmas for the Oland family this year.
