The jury at the second degree murder trial of 53 year old Joseph Irving in the death of his wife Cynthia in March of last year at their home on Carmarthen Street has heard the closing arguments from both the prosecution and defense.
The prosecution argues Irving made a conscious decision to attack his wife after she told him she wanted their marraige to end and then moved her body to the bedroom. He didn’t call 911 or check whether she was breathing. He lied about her whereabouts and moved her car to make it appear she was at work. The prosecution also telling the jury as he was choking her, Cynthia fought back but he didn’t let go.
The defense is arguing Irving should be found guilty of manslaughter because the intent to kill her hasn’t been proven by the prosecution, pointing out he has been unwavering in saying he didn’t intend to hurt her.
