Court Of Appeal Explains Why Dennis Oland Was Not Acquitted

The New Brunswick Court of Appeal has said why it ordered a new trial for Dennis Oland for second degree murder in the death of his father, Richard in July of 2011 but did not acquit him.

The Court concluded Oland did not make the case that the jury’s verdict was unreasonable. It does say the case against him was based on circumstantial evidence. There was no smoking gun and there were gaps in the prosecution’s case.

It concluded the jurors may reasonably have found Oland lied about the jacket he was wearing the night his father was murdered and that could have clinched for them the guilty verdict.

The Court of Appeal says the jacket formed a large part of the prosecution’s case.
