Officers won’t face charges after man seriously hurt during arrest

No charges will be laid against Bathurst police officers after a man was seriously hurt during an arrest.

The incident took place in July 2022 but the Serious Incident Response Team (SiRT) only received a public referral in March.

The Bathurst Police Force had received a 911 call about a domestic violence incident and someone in distress.

“While the officers were dealing with the parties on scene, the male became aggressive and pushed an officer’s arm, resulting in him being placed under arrest,” SiRT said in a news release.

“During the arrest, a struggle occurred between two officers and the male, resulting in the male being taken to the ground and injuring his shoulder.”

The man was assessed at the hospital and diagnosed with a complex shoulder fracture that required surgery, said the release.

Director Erin Nauss said while it is clear the man suffered a serious injury, she found the actions of the officers were not excessive based on a review of the matter.

“My review of the evidence indicates that there are no reasonable grounds to lay a criminal charge against the [subject officers] in connection with this incident,” said the report.
