The PC candidate who ran against Liberal Gerry Lowe in Saint John Harbour and lost by just 10 votes says he wants to get to the bottom of alleged voting irregularities.
Barry Ogden was in court on Wednesday and at that time his lawyer Kelly VanBuskirk said he had information which prompted a call from Elections NB to have the lawyer removed from the case for using what he alleges is “privileged information”
Ogden tells our newsroom he just wants to get the truth about what may have happened on September 24th.
“I thought that Elections NB was a neutral body there for the good of the people, they seem to be hiding things from us and we are just looking for information because we believe there were voting irregularities,” says Ogden.
He says this whole process has also shaken his belief in the provincial voting system.
A judge will hear a motion on Friday to have Ogden’s lawyer removed from the case.
” I just think this is just a diversion and a tactic that hurts our democracy and hurts our province and I’m calling for it to stop and to get to the truth”, stated Ogden.
Elections NB Offers Statement
The Chief Returning Officer for Elections New Brunswick released a statement surrounding the court action involving election results in Saint John Harbour.
In the statement, Kim Poffenroth says Elections New Brunswick takes no position for or against the application currently before the court.
Poffenroth goes on to say they are following procedures mandated by the Elections Act which requires a court order to inspect or produce election documents in the manner directed by the court.
It says that testimony relating to the information assembled to assist the court in respect of the issues raised in the original application has not yet been presented in court and they look forward to the opportunity to present the outcome of this review in court.
Poffenroth says it is important for everyone to allow the legal proceedings to take their course and they will not be commenting again while it is before the court.
