UPDATED: Dennis Oland Files Appeal On His Second-Degree Murder Conviction

Dennis Oland is appealing his conviction of second-degree murder in the brutal death of his father, high-profile businessman Richard Oland, and is looking to be released pending his appeal.

A document filed by Dennis Oland’s lawyers states that Oland will ask the New Brunswick Court of Appeals to allow the appeal, quash the conviction and direct a verdict of acquittal or order a new trial altogether. For the grounds of appeal, the document says that the verdict of guilty of second-degree murder was an unreasonable verdict in law and not one that a reasonable jury, properly instructed, could judicially have arrived at.

It also states that Mr. Justice Jack Walsh made various errors including in his jury instructions and in the admission of certain evidence. The jury deliberated for around 30 hours before coming back with a guilty verdict. The jury recommended he serve 10 years in prison before becoming eligible for parole.

Oland was convicted December 19th and will be sentenced on February 11th. A bail hearing for Oland will be heard on the morning of February 12th.

The prosecution can file a notice to cross-appeal.
