The Fate Of Brown’s Flat Elementary Is In A Judge’s Hands

The decision is in the judge’s hands now.

A full courtroom listening to arguments about why a decision by Education Minister Serge Rouselle to close
Brown’s Flat elementary school should be reversed.

Mr. Justice Darrell Stephenson kept referring to a letter issued by the District Education Council in late March talking about upcoming meetings with the school community including one on April 29th where a final decision will be made.

He gave credit to the group of 25 people that oppose the closure who created what he called an impressive presentation explaining their side of things.

Crown lawyer Amy Gough-Farnworth contends the DEC followed the procedure of Policy 409 and gave reasons including declining enrolment.

The crown says if the reasons are insufficient then direction is needed to provide better reasons in future but there isn’t cause to quash.

Lamrock countered saying quash it and the worst thing that happens is the school stays open for one more year.

It’s expected the decision from Mr. Justice Stephenson should take at least two weeks.
