City Responds To Proposed West Side Water Class-Action Lawsuit

The City of Saint John is rejecting allegations made in the class action lawsuit filed over west side water woes and wants the case dismissed.

It was back in mid-February that the class action was filed on behalf of west Saint Johners suffering leaking pipes and other water-related problems with damages sought.

In the statement of defence from the City, it says that the decision made to switch the water source from Spruce Lake to the South Bay Aquifer was made in good faith by the City and goes on to say it ‘exercised all due care and caution’, relying upon the best available advice.

“…the City denies that it was negligent or breached any duties of care owed to the Plaintiffs or the proposed Class Members, as alleged in the Statement of Claim, or at all,” the statement reads.

It also argues that a class proceeding wouldn’t lead to a ‘fair and efficient’ end to this case. It’s asking this be dismissed with costs and anything else the Court of Queen’s bench believes is ‘just and reasonable.’
