A trial date has been set for a Pennfield man charged with attempted murder and aggravated assault in connection with an attack on a woman in her late 50s back in April of this year.
65-year-old Brian Harold Smith made a brief appearance in provincial court, after he was ordered in late May to undergo a 30-day assessment at the Restigouche psychiatric facility in Campbellton.
Judge Henrik Tonning received a 7-page report from Dr. Taleb, a psychiatrist at the Restigouche hospital.
“The conclusion [of the assessment] of course is that Mr. Smith was not suffering from any mental disorder that would exempt him from criminal responsibility,” Judge Tonning says.
“There is no question as to his fitness.”
Smith has elected to be tried by provincial court judge alone and the one-day trial is scheduled for July 27 at 9:30am. He has been remanded back into custody until then.
Crown prosecutor Jim McAvity says they don’t anticipate more than three to four witnesses for this trial.
