Family lawyer Bill Teed says Dennis Oland did not report being assaulted in prison last summer and he did not file a complaint with prison authorities.
There were brief court appearances for the two Nova Scotia inmates at the maximum security penetentiary at Renous who are charged with assaulting Oland and adjournments were granted.
No pleas have been entered.
